Terms of Service

These Terms govern your use of Pocket Pusher, operated by Pocket Pusher. By using the game or related services, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility and age

Pocket Pusher is intended for a general audience and is not directed to children under 13. You must be at least 13 to create an account or submit personal information to Pocket Pusher. If you are under the age of majority where you live, you should use the service only with permission of a parent or legal guardian. You must be legally able to enter into a purchase transaction to make a purchase.

2. The game

Pocket Pusher is a digital arcade game. Game Coins, Gems, bonuses, Stakes, themes, upgrades and other virtual items are game features only. They are not money, stored value, securities, gambling chips, prizes, or property redeemable for cash. Pocket Pusher does not offer cash-out or real-world redemption of virtual items.

3. Accounts

You may play without an account. Optional email magic-link accounts can be used to secure and restore purchases, associate entitlements, and support account-linked features such as cloud saves. You are responsible for maintaining access to your email account and for activity performed through your authenticated Pocket Pusher session. Do not share authentication links or attempt to access another person's account.

4. Purchases

Pocket Pusher may sell permanent gameplay conveniences, cosmetic themes and consumable Coin Packs. Prices are shown before checkout and may change for future purchases. Checkout is handled by Stripe. Taxes may be added where required. A successful payment does not by itself modify the game client; fulfillment is determined by Pocket Pusher's server-authoritative purchase records.

Permanent purchases are account/entitlement rights for the feature described at the time of sale. Consumable Coin Packs are delivered to the in-game Coin balance and are designed to be consumed through play. Purchased Coins may contribute to ordinary Normal-mode progression under the current game rules. All virtual items remain subject to the game rules and have no cash value.

5. Upgrade Pack pricing

Where an Upgrade Pack price changes based on permanent upgrades you already own, the server determines the eligible price from the authoritative entitlement record. The client cannot select an arbitrary price.

6. Refunds, reversals and disputes

Our Refund Policy is incorporated into these Terms. If a payment is refunded, reversed, charged back or determined to be unauthorized, we may revoke the corresponding entitlement or adjust undelivered/unused virtual items as reasonably necessary to reconcile the transaction. Fraudulent chargebacks or abuse may result in suspension of purchasing or account features.

7. Beta and service changes

Pocket Pusher may be offered in beta or pre-release form. Features, balancing, prices, availability, game rules and technical requirements may change. We may modify, suspend or discontinue all or part of the service. We will not intentionally remove a paid permanent entitlement without providing an appropriate remedy where required by applicable law.

8. Acceptable use

You may not interfere with the service; exploit vulnerabilities; manipulate purchase or entitlement records; automate abusive requests; bypass access or payment controls; reverse engineer the service where prohibited by law; impersonate another person; use the service for unlawful activity; or attempt to obtain virtual items, refunds, account access or other benefits through fraud or deception.

9. Intellectual property

Pocket Pusher, its software, artwork, audio, branding, text, designs and other content are owned by or licensed to Pocket Pusher and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the service for personal entertainment.

10. Third-party services

Pocket Pusher relies on third-party services including payment, hosting, authentication and infrastructure providers. Their terms and privacy practices may apply to your interactions with them. We are not responsible for third-party services outside our reasonable control.

11. Disclaimers

To the maximum extent permitted by law, Pocket Pusher is provided "as is" and "as available" without warranties of uninterrupted or error-free operation. We do not guarantee that local browser data will never be lost, that every device/browser will remain supported, or that a beta feature will become permanent. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Pocket Pusher will not be liable for indirect, incidental, special, consequential or punitive damages arising from the service. Where liability cannot be excluded, our aggregate liability relating to paid digital content will not exceed the amount you paid us for the transaction or service giving rise to the claim, except where applicable law requires otherwise.

13. Termination

You may stop using Pocket Pusher at any time. We may restrict or terminate access to account or purchase features for material violations of these Terms, fraud, security threats or legal requirements. We will apply legally required consumer remedies where applicable.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent mandatory law in your jurisdiction provides otherwise. Nothing in this section removes rights that cannot be waived under applicable law.

15. Changes

We may update these Terms. Material changes will be posted with an updated effective date and, where required, additional notice.
